Welcome to GoPublica! By registering an account or using our services, you agree to these Terms of Service.
The terms "we", "our", and "GoPublica" refer to GoPublica Andrii Knapp, a company registered in Poland, NIP: 6772525332, contact: support@gopublica.com. "You" or "Client" means the business entity, company, or sole proprietorship using the Services.
1. BUSINESS-TO-BUSINESS ONLY (B2B)
GoPublica is a B2B SaaS platform intended exclusively for commercial and professional use. By creating an account, you represent that you are acting as an entrepreneur. Consumer protection regulations (including the right to withdraw within 14 days) do not apply to this agreement.
2. ACCOUNT REGISTRATION AND SUBSCRIPTION
2.1. We require accurate company details and a payment method. 2.2. The subscription begins with an immediate charge for the first billing month. A valid promo code entered at checkout may reduce this charge according to its discount and validity period. 2.3. If you do not cancel your subscription, your card will be charged automatically, and billing will recur every 30 days.
3. FEES, PAYMENTS, AND NO REFUNDS
3.1. Fees are charged in advance. Payments are processed by Stripe. 3.2. Listed prices are net prices. GoPublica will add the applicable VAT rate as required by law. 3.3. No refunds. Payments are non-refundable. We do not issue refunds for unused subscription time in the event of early cancellation.
4. LATE PAYMENTS
4.1. In case of a failed payment, the account enters a 7-day "Grace Period". 4.2. If payment is not resolved after 7 days, we reserve the right to block the Admin Panel and booking widgets. 4.3. Non-payment for 60 days may result in permanent deletion of the account and data.
5. INTELLECTUAL PROPERTY
5.1. GoPublica's Property: All software, algorithms, and platform design are the exclusive property of GoPublica Andrii Knapp. 5.2. Your Content: You retain full ownership of all data you upload to the platform (business information, customer database). You grant us only a license to technically store it in order to provide you with the service.
6. ACCEPTABLE USE
You agree not to decompile code, use bots that overload servers, or use the platform for unlawful purposes. You are responsible for the content you enter into the system.
7. THIRD-PARTY SERVICES
The platform integrates with third-party services (Stripe, Vercel, EmailJS). We are not liable for outages caused solely by these third-party providers.
8. SERVICE QUALITY GUARANTEE AND DATA LIABILITY (SLA)
8.1. Availability (Uptime): GoPublica makes every effort to ensure uninterrupted and error-free platform operation. We guarantee that we take the necessary technical steps to maintain the highest service availability, excluding planned maintenance windows of which we will provide advance notice. 8.2. Data Liability: We understand how important your customers' data is. We take responsibility for the secure storage of data entered into our databases. We implement rigorous security procedures and backups to protect your information from loss or breach. 8.3. Exclusions: Our liability does not cover outages or data breaches resulting from: (a) force majeure, (b) infrastructure failures of global providers (e.g., AWS) beyond our control, (c) gross negligence by the Client (e.g., sharing passwords with third parties). 8.4. Liability Cap: Despite our best efforts, to the maximum extent permitted by law, GoPublica's total financial liability for any claims (including data loss or downtime) is limited to the equivalent of subscription fees paid by you to GoPublica within the three (3) months preceding the event giving rise to the claim.
9. DATA PROCESSING
You act as the Controller of your end customers' data, and we act as your Processor. Details are governed by our Privacy Policy.
10. CHANGES TO TERMS
We reserve the right to modify these Terms. We will notify you of material changes with 14 days' advance notice. Pricing changes require 30 days' advance notice.
